• By using SomoTracker, you represent and warrant that you have the authority to bind yourself or your institution to these Terms.

2. Use of Services

You agree to:

• Use SomoTracker only for lawful academic, institutional, or personal purposes.
• Not misuse or attempt to disrupt our platform (e.g., by scraping, hacking, uploading malicious code).
• Not use SomoTracker to store, share, or process unlawful or unauthorized data.
• Keep your account credentials confidential and notify us of any unauthorized access.

3. Data & Privacy

• Ownership of Data: You retain ownership of all student and academic data you upload to SomoTracker.
• License to Use: By uploading data, you grant us a limited license to host, process, and display it solely to provide the Services.
• Third-Party Integrations: If you connect SomoTracker with third-party services (e.g., Google Sheets), you authorize us to access and process that data as needed.
• Privacy Policy: Our data handling practices are outlined in our Privacy Policy.

4. User Content & Responsibility

• You are solely responsible for the accuracy, legality, and reliability of any data you upload.
• You must not upload confidential student information unless you have proper authorization from your institution or applicable laws.
• We are not liable for errors or consequences arising from inaccurate or incomplete data.

5. Intellectual Property

• All rights, titles, and interests in SomoTracker (software, features, design, and trademarks) remain with us.
• You may not copy, reverse-engineer, or resell any part of the Services without our written consent.

6. Payment & Subscription

• Access to certain features may require a subscription or paid license.
• Fees, payment terms, and cancellation policies will be specified at the time of purchase.
• We may suspend or terminate access for non-payment.

7. Service Availability

• We aim to provide reliable Services but do not guarantee uninterrupted access.
• We may modify, suspend, or discontinue parts of the Services at any time, without liability.

8. Disclaimers

• SomoTracker is provided “as is” and “as available.”
• We make no warranties about accuracy, completeness, or fitness for a particular purpose.
• Data insights and analytics are for informational purposes only and should not be the sole basis for academic decisions.

9. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages.
• Our total liability for any claim related to the Services will not exceed the amount you paid (if any) in the 12 months prior to the claim.

10. Termination

• You may stop using SomoTracker at any time.
• We may suspend or terminate your account if you violate these Terms.
• Upon termination, your right to use the Services ends immediately, but certain provisions (e.g., liability, intellectual property) will survive.

11. Governing Law

These Terms are governed by the laws of Kenya, without regard to conflict of law principles. Disputes shall be resolved in the courts of Kenya.

12. Changes to Terms
